#TheGoodLife Competition Terms & Conditions Please read these Terms and Conditions carefully before entering the Competition.
1. Competition Terms and Conditions
1.1 These Terms and Conditions govern your participation as an entrant in the Standard Chartered ‘#TheGoodLife Competition (the “Competition”) organised by Standard Chartered Bank (the “Bank”) on the Bank’s (and members of the Bank’s Group’s), Instagram pages in the countries listed in clause 1.3 below (the “Sites”). More information on the Competition can be found on the Sites. These Terms and Conditions apply in addition to any applicable terms of use found on the Sites. Please read these Terms and Conditions and any other applicable terms of use (including, without limitation, Instagram Terms of Use) carefully before entering into the Competition. 1.2 To participate in the Competition you must have a valid, Instagram account. You will be required to use your Instagram account to participate in the Competition. By entering into the Competition, you are agreeing to be bound by these Terms and Conditions and any applicable terms of use found on the Sites. In addition, you are representing that the details you have provided are true and complete, including, without limitation, that you are the owner of the, Instagram account used to enter the Competition. Entrants may be asked to verify their entry (ies). 1.3 The Competition is open to residents of India only. 1.4 The Competition is open to adults only (i.e. above 18 years of age) 1.5 To participate in the activity, the participant should compulsorily follow @StanchartIN page on Instagram 1.6 Employees of the Bank and the Bank’s Group; Interface Business Solutions IBS (“IBS”) and it’s group; are not eligible to enter this Competition.
1. Entries
2.1 The Competition will run commencing on 19:00 hours (IST) <1 September 2018 and ending on 23:00hours (IST) <30 September 2018 (the “Competition Period”). 2.2 The Bank reserves the right to amend the duration of the Competition at any time and any extension will be communicated on the Sites. 2.3 To enter the Competition: (a) you shall share your entry/entries on the Site in the manner specified in the Competition details on the Sites either in the form of pictures or video; (b) your entry must be your original, personal creation, and must not have been previously submitted for entry in any competition, tweeted, published or submitted for publication; (c) your entry must be accompanied with the hashtag #TheGoodLife (the “Hash Tag”); (d) your entry must comply and be consistent with all relevant, Instagram guidelines and rules; and (e) you must obtain the permission of any individuals featured in your entry before entering this Competition, (collectively, a “Qualifying Entry”). 2.4 The Bank may, in its sole discretion, disqualify any entry which the Bank considers is not a Qualifying Entry or has been made in breach of these Terms and Conditions. This includes, but is not limited to, submission of an entry which does not meet the eligibility criteria set out in clause 2.3 above, any entrants under the age of majority in the entrant’s country of residence, submission of false details and/or submission of an entry which is obscene, libelous, defamatory, harassing or threatening. 2.5 You may upload as many entries to the Site as you wish during the Competition Period. You also agree that your Qualifying Entry(ies) will be published by the Bank on the Sites. 2.6 The publication or use of your Qualifying Entry on any of the Sites or in any other publicity materials by the Bank or IBS including as a “Featured Letter” does not indicate you have won any prize in relation to the Competition. 2.7 A panel of judges (the “Judges”) consisting of representatives of the Bank and IBS will review all Qualifying Entries and select 3 winners at the end of every week during the Competition Period, and one winner at the end of the Competition Period. Qualifying Entries will be judged by their creativity of the entry. 2.8 The decision of the Judges will be sole and final. 2.9 Any Competition inquiries may be addressed as a message to Instagram. 2.10 The Bank is not responsible for content posted by entrants or for any comments made by members of the public in relation to the entrants or their content posted on the Sites. All opinions and comments expressed by users of the Sites are expressed in their individual capacities and not as representatives of the Bank. If an opinion and comment is offensive, libelous or slanderous the Bank will use reasonable endeavours to remove such a comment or opinion, upon being notified of the same in writing (subject to the terms and conditions of the Sites).
1. Winners
3.1 The Bank intends to award prize of an Amazon gift voucher worth INR 1000/- (Rupees One Thousand Only) to each of the 3 winners every week. At the end of the Competition Period there will be one final prize of free dinner for two at any of the restaurants that are part of ‘the Good Life Dining Program’. 3.2 The winners will be announced on Instagram as follows: (a) Weekly winners will be declared at the beginning of the next week in a post on Instagram. The Amazon vouchers will be emailed to their email IDs shared with the bank. Final prize winners will be announced in a post on Instagram to which the relevant Qualifying Entry was submitted identifying and tagging each winner within 2 days of the end of the Competition Period. 3.3 The winners are deemed to have accepted the prize(s) when they respond to the Bank’s announcement through Instagram with all requested information within 2 business days of the announcement of such winner. 3.4 If a winner fails to accept his/her prize within the time periods set out above, the Bank reserves the right to select another entry to replace that original winner. If such replacement should occur, no alternative prize will be offered to the original winner and the original winner will have no claim whatsoever against the Bank, its agents and employees in the event of forfeiture thereof. The Bank’s decision will be final and no inquiries or appeals will be entertained. 3.6 Prizes are non-transferable and subject to availability. Prizes are not redeemable for cash or other prizes. The Bank reserves the right to substitute alternative prizes which may not be of equivalent value at any time by giving notice on the Sites or otherwise notifying the relevant winners. 3.7 The winner may be required to participate in public relations events to generate press coverage for the Competition. This may include without limitation quotes given by the winners for inclusion in press releases, attendance at prize giving ceremonies, press conferences and interviews. 3.8 The Bank shall have no liability, and you will indemnify the Bank from and against any liability, loss, claim, damage or costs of any kind (including legal costs) to any person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Competition. 3.9 The Bank is not responsible for entries to the Competition that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect, incomplete, for any reason whatsoever, will not be eligible. The Bank, in its sole discretion, reserves the right to disqualify any person tampering with the Competition process or the operation of the Sites. 3.10 To the extent permitted by applicable law, you agree that the Bank, the Bank group cannot accept responsibility, under any circumstances and in any way, for any errors or omissions, loss, damage, injury or disappointment suffered as a result of your entry in the Competition or any content posted on the Sites associated with the Competition. 3.11 Participation in the Competition is not transferable.
1. Intellectual Property
4.1 By submitting an entry for the Competition or uploading any material for the purposes of the Competition (whether photos, written submissions or other material) (“Content”), you: (a) confirm that the Content is your original creation and is personal to, and relates specifically to you and warrant that the Content will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libelous, defamatory, obscene, harassing or threatening; (b) agree that the Bank and IBS (and each of their respective Group members) may use, publish, modify, adapt, rework, broadcast and reproduce the Content without limitation or charge on a worldwide basis and in any and all media for any purpose including, without limitation, operating and promoting the Competition; and (c) agree that any moral rights you have in the Content are, or will be, waived to the fullest extent possible and confirm that you have obtained any third party to waive his / her moral rights that he / she may have in the Content. 4.2 All promotional images produced by the Bank or any member of the Bank’s Group in connection with the Competition, entrants, winners and prizes will be the property of the Bank. 4.3 You agree that, if you participate or if you become a winner of the Competition, the Bank and IBS (and each of their respective Group members) may publicize your name and photograph in any medium including, without limitation, on the Sites, the official websites of the Bank and IBS, (or any of their respective Group members) and other similar Sites. 4.4 “Standard Chartered”, “Standard Chartered Bank”, , are the registered trademarks of Standard Chartered PLC and no permission or license is granted to use any such trademarks without the prior written consent of Standard Chartered PLC.
1. Data Protection
5.1 You agree that personal information collected by the Bank or IBS about you can be used by the Bank, and also disclosed to, and used by, persons who are involved in operating or promoting the Competition (including IBS and its Group, other members of the Bank’s Group and Bank’s Group service providers). Such disclosure may require the transfer of your personal information to parties located in countries that do not offer the same level of data protection as your resident country. However, the Bank will take steps to ensure that parties to whom your personal information is transferred will treat your personal information securely and confidentially and only use such personal information for the purposes set out herein. Your personal information will not be shared with any other third party for purposes outside the operation or promotion of the Competition, including marketing. 5.2 Your information will be retained for as long as required in connection with the Competition. It will then be destroyed unless further retention is required to satisfy our legal, regulatory or other obligations or to protect our interests. 5.3 If you wish to access your information, correct/delete any of your information or have any other questions regarding these data protection terms, please contact the bank through its any one of the sites. The Bank may charge a nominal fee for access to or correction of the information held. 5.4 Save for the Sites which the Bank controls, you acknowledge that the Bank does not own, control or host, Instagram and the relevant privacy policy found on, Instagram and at the respective Sites will apply.

1. Miscellaneous
6.1 The Bank reserves the right, in its sole discretion, to modify, suspend, and/or terminate the Competition (or part thereof) for any reason, including, but not limited to, if a computer virus, bug, unauthorised human intervention or other cause (a “Disrupting Event”) corrupts or impairs the administration, security, fairness, judging, or proper play of the Competition. If the Competition is so modified, suspended or terminated, the Bank will communicate the modification, suspension or termination on the Sites and the Bank reserves the right to award prizes to an entrant from among all entries received prior to such modification, suspension or termination (as applicable). 6.2 You acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with, , Instagram. To the extent permitted by applicable law, you agree that Instagram will not be liable, under any circumstances and in any way, for any errors or omissions, loss or damage of any kind incurred as a result of your use of the Sites and participation in the Competition. 6.3 For the purposes of these Terms & Conditions, “Group” means, in relation to a party: (a) any person, body corporate, partnership, firm or other entity in which the party directly or indirectly: (i) owns more than half the capital or business assets; (ii) has the power to exercise fifty percent (50%) or more of the voting rights; (iii) has the legal power to direct or cause the direction or general management or affairs; (iv) has the power to appoint more than half the members of the supervisory board, board of directors or other legally representative body; or (v) has the right to manage the business; (b) any person, body corporate, partnership, firm or other entity which directly or indirectly has in or over the party the rights or powers listed in (a) above (a “Controller”); and/or (c) any person, body corporate, partnership, firm or other entity in which a Controller directly or indirectly has the rights or powers listed in clause 6.3(a) above. 6.4 If any provision of these Terms and Conditions is wholly or partially void or unenforceable, it shall be deemed severed to the extent that it is void or unenforceable. In such circumstances, the validity or enforceability of the remainder of these Terms and Conditions shall not be affected.
