      Standard Chartered Unlimited Foreign Currency Cashback (15 February to 30 April 2019) Promotion and Paris Lucky Draw Promotion Terms and Conditions

      1. The Standard Chartered Unlimited Foreign Currency Cashback (15 February to 30 April 2019) Promotion and the Paris Lucky Draw Promotion (collectively, the “Promotions” or the “Unlimited Feb 2019 Promotion”) are available from 15 February 2019 to 30 April 2019 (both dates inclusive) (the “Promotion Period”). By participating in these Promotions, you agree to be bound by these terms and conditions.

      Eligibility Criteria

      1. To be eligible for these Promotions, you must apply for the Unlimited Cashback Credit Card (the “Card”) issued by Standard Chartered Bank (Singapore) Limited (“Standard Chartered”, the “Bank” or “we”) as a principal cardholder and your Card must be approved during the Promotion Period. For the avoidance of doubt, if your card is approved after 30 April 2019 due to any reason, you will not be eligible to participate in these Promotions.
      1. If you fulfil the conditions set out in this Clause 2 and your Card account has not been suspended, cancelled or terminated for any reason during the Promotion Period, you will be considered to be eligible for the Promotions (an “Eligible Cardholder”).

      Promotional Cashback

      1. Subject to Clauses 2 and 3 above, you can participate in this Standard Chartered Unlimited Foreign Currency Cashback Promotion when you (including your supplementary cardholder(s) on your Card account) charge Eligible Foreign Currency Retail Transactions (as defined at clause 5 below) to the Card and such transactions are posted to your Card account between 15th February 2019 and 30th June 2019 (both dates inclusive) (“Cashback Eligibility Period”) to receive a total of 3% cashback.
        1. This 3% cashback comprises:
          1. the 1.5% cashback (“Unlimited Cashback“) you are eligible to receive when you (including your supplementary cardholder(s) on your Card account) use the Card in the manner specified in the Standard Chartered Unlimited Cashback Credit Card Terms and Conditions; and
          2. an additional 1.5% cashback (“Promotional Cashback”) on Eligible Foreign Currency Retail Transactions on your Card (as defined at Clause 5 below and inclusive of any Card held by your supplementary cardholder(s)) if such transactions are posted to your Card account during the Cashback Eligibility Period. For the avoidance of doubt, the date the transaction is charged may not be the same as the date the transaction is posted due to factors including but not limited to processing time and differences in time zones (where applicable).

       Promotional Cashback on Eligible Foreign Currency Retail Transactions

      1. Promotional Cashback is awarded only on retail transactions charged in a currency that is not Singapore Dollars, which exclude those transactions listed in Clause 7 below (such eligible retail transactions to be referred to as “Eligible Foreign Currency Retail Transactions”) made on your Card based on the date such transactions are posted to your Card account. For clarity, Eligible Foreign Currency Retail Transactions charged to the Card in a calendar month but yet to be posted to the Card account by the end of that month in which it was charged will not be taken into account in the computation of Promotional Cashback earned for that month. Promotional Cashback is computed each month and will be calculated up to two decimal places for each individual Eligible Foreign Currency Retail Transaction without any rounding off. For the avoidance of doubt, the Promotional Cashback and the Unlimited Cashback are calculated over different periods (the former is calculated each calendar month and the latter is calculated each statement cycle month) and therefore, the Promotional Cashback will not be reflected and credited together with the Unlimited Cashback you are eligible to receive. The Promotional Cashback you are eligible to receive will be credited to your principal Card account by the 30th day of the next calendar month. For example, any Promotion Cashback earned in April 2019 will be credited by 30 May 2019. The Promotional Cashback amount will be automatically offset against the credit card statement payment due amount for the statement cycle month (which includes the date the Promotional Cashback is credited into your principal Card account). Promotional Cashback earned by your supplementary cardholder(s) of the Card will be credited into your principal Card account.
      1. For Eligible Foreign Currency Retail Transactions charged to the Card, the transaction amount authorised in the Eligible Cardholder’s Card account (which is inclusive of the exchange rate conversion fees but exclusive of the overseas transactions fees, if any) will be considered in determining whether the Eligible Cardholder has made an Eligible Foreign Currency Retail Transaction.
      1. The following transactions are not Eligible Foreign Currency Retail Transactions and will not earn Promotional Cashback:
        1. any transactions charged in Singapore Dollars (including but not limited to overseas transactions that are billed in Singapore Dollars, any fees and charges such as annual fees, late payment fees, interest charges, and or finance charges, balance transfer or fund transfer, AXS or ATM transactions made using the Card, tax refunds credited to your Card (and/or your supplementary credit card), tax payments charged to your Card (and/or your supplementary credit card));
        2. any cash advance;
        3. any monthly instalment of an EasyPay transaction;
        4. any amount charged to your Card (and/or your supplementary credit card) that is subsequently cancelled, voided, refunded or reversed;
        5. recurring payments or payments made to all billing organisations using Standard Chartered Online Banking;
        6. amounts which have been rolled over from the preceding months’ statements;
        7. any insurance premiums charged to your Card (and/or your supplementary credit card)
        8. any top-ups or payment of funds to any prepaid cards and any prepaid accounts including without limitation to the following accounts or any other accounts as we may specify from time to time:

        10. any other charge, fee, transaction or payment as we may stipulate from time to time.
      1. For the purposes of computation and award of the Promotional Cashback under this Promotion, refunded transactions will be deducted from the amount ascertained to be the sum of that month’s Eligible Foreign Currency Retail Transactions. Any portion of the Promotional Cashback credited for such transactions will be reversed in the following month’s Card statement.
      1. We may retract, deduct, re-compute, withdraw and/or cancel any Promotional Cashback awarded if you fail to effect the minimum payment due as reflected on that month’s Card statement, abuse the cashback programme or for any other reason that we may deem fit in our sole discretion. You will not be entitled to any payment or compensation in respect of such retraction, deduction, re-computation, withdrawal or cancellation.

      Paris Lucky Draw Promotion

      1. For a transaction to be eligible for the Paris Lucky Draw Promotion, the following conditions must be met. The transaction must:
        1. be an eligible retail transaction of S$150 or more (which excludes those transactions set out in Clause 7 (b) to (i) above) made by either the Eligible Cardholder or his/her supplementary cardholder(s);
        2. have a transaction date falling within the Promotion Period;
        3. be successfully posted to the Card account during the Promotion Period; and
        4. the successfully posted transaction cannot be reversed, cancelled or voided on or before 30 April 2019,(each such transaction which fulfils clauses 10(a) to 10(d) hereinafter referred to as a “Paris Lucky Draw Qualifying Transaction”).
      1. Every Paris Lucky Draw Qualifying Transaction will allow you one chance to participate in the lucky draw for the Paris Lucky Draw Promotion (“Paris Lucky Draw”), provided you meet the conditions set out in clauses 2,3 and 10 above. There is no cap on the number of chances for participating in the Paris Lucky Draw.
         
        For non-Singapore dollar Paris Lucky Draw Qualifying Transactions charged to the Card, the transaction amount authorised in the Eligible Cardholder’s Card account (which is inclusive of the exchange rate conversion fees but exclusive of the overseas transactions fees, if any) will be considered to determine if the Eligible Cardholder has made a Paris Lucky Draw Qualifying Transaction. 
      Illustration:
      Client has spent S$2,550 between 15th February and 30th April 2019. Client will earn a total of 17 chances to participate in the Paris Lucky Draw.
      Client has spent S$3,250 between 15th February and 30th April 2019. Client will earn a total of 21 chances to participate in the Paris Lucky Draw.
      Client has spent S$4,000 between 15th February and 30th April 2019 and S$1,000 on 5th May 2019 Client will earn a total of 26 chances to participate in the Paris Lucky Draw. The S$1,000 of spends on 5th May 2019, which is post the campaign end date will not earn any chances for the Paris Lucky Draw promotion.
      1. By participating in the Paris Lucky Draw, an Eligible Cardholder can win a trip to Paris (the “Paris Trip”). The Paris Trip comprises return economy flight tickets for two (2) persons on an airline of the Bank’s choice from Singapore to Charles de Gaulle Airport, Paris and a 4 days 3 nights package for 2 persons that comprises transfer from Charles de Gaulle airport (arrival and departure) to the hotel, all travel as per a planned itinerary, accommodation, a professional makeover session, a photo shoot around Paris’ sites and dinner atop the Eiffel Tower at the Le Jules Verne restaurant. The cost for any trip extensions is not included as part of the package. All components of the Paris Trip as stated in this clause are subject to change at the discretion of Mastercard.
      2. The Paris Lucky Draw is subject to the availability of the Paris Trip. For clarity, the availability of the Paris Trip will be updated on sc.com.sg/unlimited and Eligible Cardholders have the responsibility to check on the availability prior to participation.
      3. The winning cardholder who will receive the Paris Trip will receive a notification letter (“Prize Notification Letter”) from the Bank sent to his/her registered mailing address with the Bank informing him/her of the relevant trip details by 30 June 2019. Mastercard Asia/Pacific Pte Ltd (“Mastercard”) will be administering the redemption and/or supplying the Paris Trip to the Bank. To facilitate the redemption of the Paris Trip, you will be required to provide you and your travel companion’s personal data to Mastercard for the fulfilment of the trip, including the fact that you are a customer of the Bank. By providing you and your travel companion’s personal details to Mastercard, you understand and agree that Mastercard may collect, use and disclose you and your travel companion’s personal data to their partners/suppliers for the redemption of the Paris Trip. Any dispute relating to or arising from the fulfilment of the trip must be resolved directly with the relevant party such as Mastercard and its partners/suppliers and not with the Bank. You agree and warrant to raise all complaints pertaining to the quality and servicing of the trip directly with Mastercard.
      4. The Paris Trip is strictly not transferable, assignable or exchangeable for cash, gift vouchers or any other items.
      5. The chances for the Paris Lucky Draw will be randomly allocated and the winner will be picked by our computer programme designed specifically for the purpose of the Paris Lucky Draw Promotion at 9 Changi Business Park Crescent, Standard Chartered Bank @ Changi 2, Singapore 486005. The Paris Lucky Draw Promotion draw date will be on 25 June 2019.
      6. The random selection of the winner for the Paris Lucky Draw Promotion will be verified by external auditors. We reserve the discretion to change any of the Paris Lucky Draw Promotion mechanics without giving prior notice or reason (and the Bank shall not be obliged to disclose its reason). We may appoint any party as we deem fit as an external auditor for the Paris Lucky Draw Promotion.
      7. The Paris Trip must be redeemed or claimed by you by 31 July 2019 or such other date as determined by the Bank. The travel dates for the Paris Trip is slated on 25 September 2019 to 28 September 2019 and Mastercard will not extend the aforesaid period for any reason whatsoever.
      8. The Bank is not an agent of Mastercard and makes no representation as to the quality, condition or performance of the Paris Trip (or any of its components) and the goods and services provided by them. The acceptance of the Paris Trip and enjoyment of the Paris Trip is also subject to Mastercard’s terms and conditions. Any dispute about quality or performance of the Paris Trip (or any of its components) or the goods and services provided as part of the campaign shall be governed by those terms.
      9. You and your travel companion travelling on and enjoying the Paris Trip shall be solely responsible for obtaining all necessary travel documentation including, without limitation, passports and visas. All expenses (including, without limitation, taxes, fees, gratuities and other expenses) (“Expenses”) incurred in connection with the aforementioned shall be borne solely by you and your travel companion. Except for the items forming part of the Paris Trip (as stated in the Prize Notification Letter) which shall be borne by the Bank and Mastercard, any other Expenses or costs that you and your travel companion incur for and during the Paris Trip including, without limitation, insurance including travel insurance, transport and meals shall also be borne solely by you and your travel companion. The Bank and Mastercard shall not be responsible for any consequences, including but not limited to costs incurred, if you and/or your travel companion is unable to travel overseas for the Paris Trip, whether by reason of your failure to obtain the necessary visa or otherwise.
      10. The Bank makes no warranty or representation as to the quality, value, merchantability or fitness for purpose of the Paris Trip.Except for death or personal injury caused by the negligence of the Bank, the Bank shall not be responsible for, and you and your travel companion agree to release and hold the Bank harmless for, any expenses, loss (whether foreseeable or not), claim or damage that you and/or your travel companion suffered or incurred (whether in common law or equity) arising from or in connection with, directly or indirectly, you and your travel companion’s travel and enjoyment of the Paris Trip to the fullest extent permitted by law. The Bank is not obliged to assist or act on your behalf in communicating with the merchants supplying the Paris Trip for any reason. You accept the Paris Trip as it is and subject to any terms and conditions the merchants may impose.

      General conditions governing the Promotions

      1. For purposes of these terms, “month” means a calendar month and “statement cycle month” means the period from the statement date of a particular month to the day falling one day prior to the statement date of the following month.
      2. For any new transaction payable by monthly instalment payments, for the purposes of Promotional Cashback, if you charge the total amount in respect of such Eligible Foreign Currency Retail Transaction to your Card within a particular month where such total amount is successfully converted to monthly instalments at a later date by us, the total amount charged (and not the converted monthly instalment amount) will qualify for Promotional Cashback provided that (i) such new transaction payable by monthly instalment payment is a Eligible Foreign Currency Retail Transaction; and (ii) such monthly instalment amount is successfully posted to your Card account before the end of that month. Subsequent monthly instalment amounts will not qualify for Promotional Cashback for such months in which the relevant instalment amount is posted.
      3. We are not responsible and accept no liability for any failure or delay in the transmission of a transaction and/or Eligible Foreign Currency Retail Transaction by any party (including but not limited to Mastercard/Visa acquiring merchants, merchant establishments, or any telecommunication provider) for whatsoever reason.
      4. Your Card account must be in good standing and conducted in a proper and satisfactory manner, as we may determine in our sole discretion, at the time of crediting the Promotional Cashback. In the event that your Card account is delinquent, terminated or suspected for any reason whatsoever before the Promotional Cashback is credited into your Card account, we reserve the right to forfeit such Promotional Cashback at our sole discretion without prior notice.
      5. We accept no liability for any late submission of any transaction and/or Eligible Foreign Currency Retail Transaction by any merchant for whatsoever reason.
      6. Any Promotional Cashback, if credited to your Card account for any of the transactions listed under Clause 7, will be reversed at our sole discretion without prior notice.
      7. In the event the Bank has determined that an Eligible Cardholder is not eligible to receive the Prize or to participate in the Promotions, or where the Bank has knowledge of subsequent events which would mean that the Eligible Cardholder would not have been entitled to redeem the Prize (including but not limited to where the charges used to meet the relevant minimum spend(s) were reversed or refunded), the Bank reserves the right to claw back the Prize or to deduct its value (or such other amount as it deems fit) from the Eligible Cardholder’s account(s) with the Bank.
      8. The Card is excluded from earning rewards under the Standard Chartered 360° Rewards Programme.
      9. Unless otherwise stated, these Promotions are not valid with other offers, discounts, rebates, vouchers, privileges or promotions. These Promotions are valid in conjunction with the Credit Cards Sign-Up Promotion Terms and Conditions (the terms and conditions of which can be found here), the Standard Chartered Caltex 2019 Promotion (the terms and conditions of which can be found here) and The Good Life® 2019 Promotion (the individual merchant and general terms and conditions of which can be found here).
      10. We reserve the right to vary, modify, and amend any of these terms, including but not limited to the right to:
        1. extend, shorten, suspend or terminate these Promotions;
        2. vary the rate of Promotional Cashback; and
        3. vary the basis of calculation of Promotional Cashback and the retail transactions which are not Eligible Foreign Currency Retail Transactions); from time to time without prior notice or reason.
          You agree that you are bound by such variations, modifications, and amendments.
      11. We reserve the right to determine at our sole and absolute discretion all matters arising out of or in connection with these Promotions. Our determination of all matters relating to these Promotions shall be final and conclusive, final and binding on you and your supplementary cardholders and no correspondence will be entertained.
      12. Except for death or personal injury caused by the negligence of the Bank, to the fullest extent permitted by law, the Bank accepts no liability for the goods and services provided by any merchant or service provider. In case of any disputes, the decision of the Bank and the respective merchants shall be final.
      13. The Bank is not an agent of any merchant or service provider or vice versa.
      14. In the event of any inconsistency between these Promotion Terms and Conditions and any brochures, marketing or promotional materials relating to the Promotions, these Promotion Terms and Conditions shall prevail to the extent of such inconsistency.
      15. By participating in these Promotions, you consent to the use of your personal data for marketing purposes, including but not limited to the use of your telephone number to contact you about products and promotions offered by the Bank from time to time via telephone, SMS or multimedia messaging. Such consent will supersede any prior choices made by you. Such consent will also prevail even if you are registered or subsequently register your contact information with the national Do Not Call Registry.
      16. These Standard Chartered Unlimited Foreign Currency Cashback (15 February to 30 April 2019) Promotion and Paris Lucky Draw Promotion are to be read in conjunction with our Standard Chartered Unlimited Cashback Credit Card Terms and Conditions, Customer Terms and Credit Card Terms (collectively, the “Other Terms“). In the event of any inconsistency between these terms and the Other Terms, these terms prevail only to the extent of such inconsistency.
      17. A person who is not a party to these terms and conditions has no rights under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of these terms and conditions.
      18. These terms and conditions are governed and construed in accordance with the laws of Singapore. Any dispute arising out of these terms and conditions shall be referred to the exclusive jurisdiction of the Courts of Singapore.
