Summary of the sections of Customer Terms

Background

We wrote to you previously in December 2013 ("Notification") to notify you that we are making changes to the terms and conditions governing accounts established before 7 October 2013.

Who should read this?

This summary is prepared for customers holding accounts governed by the Old Terms (as defined in the Notification and on the website notifying such changes) for the purpose of helping these customers (who are new to Customer Terms) to understand the framework of Customer Terms.

This is only a summary and you should read the full version of the latest Customer Terms carefully. If there is any inconsistency between this summary and the latest Customer Terms, the latest Customer Terms are correct.

S/N Section Summary of Each Section of Customer Terms
1. Part A (Our banking relationship) This section sets out the basis of our banking agreement with you.
2. Part B (Operating accounts) This section sets out the scope of your account operating authority, how we receive and act on instructions from you and the form of notices and communications.
3. Part C (Electronic banking) This section sets out the terms of use of our electronic banking services, including online banking, ATM and debit card services, phone banking, SMS banking, mobile banking, fund transfer services and eStatements.
4. Part D (Cards) This section sets out the general terms of use of our ATM cards, debits cards and credit cards.
5. Part E (Security Procedures and Liability) This section sets out the security procedures for our banking services, terms regarding the loss, theft or misuse of security codes, passbooks or cheque books, and liability for transactions.
6. Part F (Payments) This section sets out the interest, fees and costs that may be payable by you in connection with our banking agreement, our right to set off any amount we owe you against any amount you owe us, our right to make currency conversions, and the indemnities that you give us in relation to any loss that we may suffer except where such loss arises from any fraud, wilful misconduct or gross negligence by us.
7. Part G (Information, statements and records) This section sets out your representations and warranties on the information that you give us, your consent to our disclosure and use of your information, and the conclusiveness of our records in relation to our banking agreement.
8. Part H (Termination, suspension, and enforcement) This section sets out how you or we may terminate our banking agreement, what happens on termination, the enforcement actions which we may take in relation to our banking agreement, and when we may suspend or convert your accounts with us.
