Christmas 2017 Promotion Terms and Conditions

Eligibility

  1. The Christmas 2017 Promotion (“Promotion“) is available from 1 November to 31 December 2017 (both dates inclusive) (“Promotion Period“). The Promotion is open to all eligible principal cardholders of Standard Chartered Credit and MANHATTAN Cards (“Cards“) issued by Standard Chartered Bank (Singapore) Limited in Singapore (“Bank”) (collectively, “Eligible Cardholders“). By participating in the Promotion, Eligible Cardholders agree to be bound by these terms and conditions.
  2. The Promotion comprises of the following:
    1. The Shop Shake Win Promotion (“Shop Shake Win Promotion”);
    2. The Spend and Redeem Promotion (“Spend and Redeem Promotion”); and
    3. The Cashback on Foreign Currency Transaction (“Cashback Promotion”).
  3. Unless otherwise stated, the Promotion is not valid with other offers, discounts, rebates, vouchers, privileges or promotions. The Promotion is valid in conjunction with the Standard Chartered and Uber 2017/2018 Promotion (the terms and conditions of which can be found here) and the Standard Chartered Caltex 2017 Promotion (the terms and conditions of which can be found here).
  4. The following Cards are not eligible for the Promotion:
    1. Corporate Liability Cards; and
    2. Debit Cards.
  5. Eligible Cardholders whose Cards’ accounts have been suspended, cancelled or terminated for any reason during the Promotion Period and until 15 February 2018 are not eligible for the Promotion.

Participation

  1. To participate in the Promotion, Eligible Cardholders must successfully register their Card (“Registered Card“) by:
    1. Sending an SMS in the format set out in Clause 8 below (“SMS Registration“); or
    2. Registering online at our website (“Online Registration”) at sc.com/sg/christmas (“Website“) during the Promotion Period.
  2. The Promotion is limited to the first 100,000 registrations received by us via SMS Registration and/or Online Registration during the Promotion Period. The Bank will not accept any:-
    1. Attempts to register before and/or after the Promotion Period;
    2. Registrations after the first 100,000 registrations; and
    3. Registrations that are not in the prescribed format (as set out at Clauses 8 and 9 below).

All such registrations will be considered by the Bank to be invalid and/or void, and the Bank’s determination shall be final and conclusive.

  1. For SMS Registrations, all SMSes must be composed in the following format:

“XMAS<space>16-digit Standard Chartered Credit Card number”

(Example: XMAS 4509123456789000)

The composed SMS must be sent to 77222. All SMS Registrations which are not in this prescribed format will not be accepted and will be considered by the Bank to be invalid and/or void, and the Bank’s determination shall be final and conclusive.

  1. For Online Registrations, Eligible Cardholders must register and submit their 16-digit Standard Chartered Credit Card number via the Website.
  2. An acknowledgement of successful registration will be sent to the mobile number which the Eligible Cardholder had used for his/her registration (in the case of SMS Registration) or reflected on the registration webpage (in the case of Online Registration).
  3. Subject to Clause 17 below in relation to the Shop Shake Win Promotion, Eligible Cardholders may register their Cards anytime within the Promotion Period. Eligible Cardholders may register multiple Cards for the Promotion subject to these terms and conditions. Eligible Cardholders need to register once for each Card by either SMS Registration or Online Registration.
  4. It is the Eligible Cardholder’s responsibility to ensure that the correct Card number, to which transactions are intended to be charged under the Promotion, is submitted in the SMS Registration or Online Registration. If an Eligible Cardholder, having successfully registered a particular Card number by SMS Registration or Online Registration, charges an amount to a different Card which has not been registered for the Promotion, such amount will not be considered as a Shop Shake Win Qualifying Transactions, Spend and Redeem Qualifying Transactions and Cashback as defined at Clause 15, Clause 25 and Clause 32 below) (collectively, “Qualifying Transactions”).
  5. The speed and reliability of service of the Eligible Cardholder’s internet and/or mobile connection is dependent solely on his/her respective internet and/or mobile service providers. The Bank is not responsible or liable in any manner whatsoever for any delay or failure in the transmission or receipt of any SMS Registration and Online Registration, or any failure to register resulting from the same. Eligible Cardholders shall be solely responsible for all fees and charges imposed by their service providers in the SMS Registration and/or the Online Registration (as the case may be).
  6. By registering for the Promotion and participating in the Promotion, the Eligible Cardholder consents to the use of his/her personal data for marketing purposes, including but not limited to the use of his/her telephone number to contact him/her about products and promotions offered by the Bank from time to time via telephone, SMS or multimedia messaging. Such consent will also prevail even if the Cardholder is registered or subsequently registers his/her contact information with the national Do Not Call Registry.

The Shop Shake Win Promotion

  1. To qualify for the Shop Shake Win Promotion, Eligible Cardholders must during the Promotion Period charge an amount of $150 or more based on transaction date in a single transaction to the Registered Card for eligible purchases and where the corresponding transaction is successfully posted to the Registered Card account during the Promotion Period (each, a “Shop Shake Win Qualifying Transaction”).
  2. The first 160,000 Shop Shake Win Qualifying Transactions (each a “Winning Transaction”) during the Promotion Period will be randomly assigned a unique URL sent via a SMS by an automated computerised system. A SMS containing this unique URL will be concurrently sent to the Eligible Cardholder’s registered mobile number with the Bank when such Shop Shake Win Qualifying Transaction is a Winning Transaction. This Promotion is limited to the first 160,000 Shop Shake Win Qualifying Transactions and SMSes will only be sent to the Eligible Cardholders of the first 160,000 Shop Shake Win Qualifying Transactions.
  3. There is a processing period for SMS Registrations and Online Registrations received by us. Your registration will take 2 days from the time of registration to take effect successfully. For the purposes of the Shop Shake Win Promotion, amounts charged to the Registered Card before processing is completed will not be considered as Shop Shake Win Qualifying Transactions. The table below illustrates the corresponding dates Eligible Cardholders will qualify for depending on the respective days/times that their registrations are received by us:

For Registrations we receive between 1 November 2017 12:00am and 29 December 2017 11:59pm, there will be a 2-day lag period. For example, if an Eligible Cardholder registers his Card on 22 November 2017 (Wednesday), his registration will only take effect on 24 November 2017 (Friday).

 

  1. Each Eligible Cardholder is eligible for 1 unique URL sent via 1 SMS with every Shop Shake Win Qualifying Transaction made.

  1. We reserve the right to determine at our sole and absolute discretion whether:
    1. a Card is to be or has been registered;
    2. Eligible Cardholders have met all the requirements of the Promotion; and
    3. charges made to the Registered Card qualify towards fulfilment of the Shop Shake Win Qualifying Transaction and/or Winning Transaction criteria for the purposes of this Promotion.
  2. The Eligible Cardholder of each Winning Transaction (“Winning Cardholders”) will win one of the following prizes:
    1. $2 cashback
    2. $3 cashback
    3. $5 cashback
    4. $10 cashback
    5. $20 cashback
    6. $50 cashback
    7. $100 cashback
    8. $300 cashback
    9. $1,000 cashback
    10. $10,000 cashback

(each a “Prize” and collectively, “Prizes”)

For the avoidance of doubt, if an Eligible Cardholder does not receive one of the 160,000 Winning Transaction SMSes, he/she will not be entitled to any of the Prizes above.

The Shop Shake Win Promotion is subject and limited to the availability of the Prizes above.

  1. The random selection and allocation of Prizes to the respective Winning Cardholders of the Winning Transactions will be verified by external auditors. We reserve the discretion to change any of the Prize allocation mechanics without giving prior notice or reason. We may appoint any party as we deem fit as an external auditor for the Prize allocation.
  2. The Prizes are not transferable or exchangeable for cash or any other items.
  3. All cashback Prizes will be credited to the relevant Winning Cardholders’ Registered Card Account by 15 February 2018. SMSes will be sent to the relevant Winning Cardholder’s registered mobile number with the Bank to inform them that the Prize amount has been credited to their Registered Card. The details of the Prize amount will be reflected in the relevant Winning Cardholder’s next Statement of Account.

The Spend and Redeem Promotion

  1. To qualify for the Spend and Redeem Promotion, the Eligible Cardholder must be within the first 1000 cardholders to meet the minimum spend requirement of $18,000 in retail transactions based on transaction date (which excludes those transactions set out at Clause 40 below) to a Registered Card (“Spend and Redeem Qualifying Transactions”) during the Promotion Period. Eligible Cardholders who successfully qualify for the Spend and Redeem Promotion will receive a 1 night weekend stay at Andaz Singapore Hotel by Hyatt (“Gift”).
  2. Each Eligible Cardholder is only eligible for one (1) Gift under the Spend and Redeem Promotion. In the event that multiple Cards have been registered by him/her, the Gift will be determined based on the Registered Card with the highest spend amount. The Bank will not combine or consolidate spend amounts on different Cards for this Spend and Redeem Promotion.
  3. The Gift is strictly non-transferable and non-exchangeable (for cash or credit or otherwise).
  4. Eligible Cardholders who have qualified to receive the Gifts will be notified either by mail or SMS by no later than 15 February 2018

The Cashback Promotion

  1. For purposes of the Cashback Promotion, Qualifying Foreign Currency transactions (“Eligible Transactions”) are foreign currency spends charged to the Eligible Card account (which, for the avoidance of doubt, must be made in foreign currency), provided that such transaction is not a transaction made on the Uber app. For the avoidance of doubt, transactions made on the Uber app will not be considered as Eligible Transactions for this Cashback Promotion. Purchases beyond Singapore but charged in Singapore Dollar will not be considered as Eligible Transactions for this Cashback Promotion. Purchases in Singapore but charged in foreign currency which are not transactions made on the Uber app will be considered as Eligible Transactions for this Cashback Promotion.
  2. To qualify for Cashback under the Cashback Promotion, the Eligible Cardholder must be within the first 5,000 cardholders to meet the minimum spend requirement of $9,000 (“Cashback on Foreign Currency Transaction Minimum Spend”) in his/her total eligible spends (which excludes those transactions set out at Clause 40 below) on his/her Registered Card (“Cashback on Foreign Currency Qualifying Transactions”) during the Promotion Period.
  3. Subject to Clause 33, if the Eligible Cardholder has more than one Registered Card and wishes to aggregate the amounts of Eligible Transactions from his/her Registered Cards, to qualify for Cashback under the Cashback Promotion, each Registered Card must satisfy the Cashback on Foreign Currency Transaction Minimum Spend in Cashback on Foreign Currency Qualifying Transactions during the Promotion Period.
  4. If an Eligible Cardholder satisfies the conditions in Clauses 30 or 31 above, then he/she will be entitled to a 10% cashback (“Cashback”) on all Cashback on Foreign Currency Qualifying Transactions made on the Registered Card(s) during the Promotion Period. The maximum amount of Cashback that can be awarded to each Eligible Cardholder under the Cashback Promotion is capped at S$100.

Of this S$9,000, S$800 is from Eligible Transactions in accordance with Clause 29. Yes, 10% Cashback on the S$800 of Eligible Transactions will be awarded for the Promotion Period provided that the cardholder is within the first 5,000 to meet the Minimum Spend criteria of S$9,000. The Cashback amount will be S$80.
Eligible Cardholder charges a total of S$9,000 in Cashback on Foreign Currency Qualifying Transactions during the Promotion Period to his/her Registered Card. Of this S$9,000, S$1500 is from Eligible Transactions in accordance with Clause 29. Yes, 10% Cashback on the S$1500 of Eligible Transactions will be awarded for the Promotion Period provided that the cardholder is within the first 5,000 to meet the Minimum Spend criteria of S$9,000. However, the Cashback amount awarded will be capped at S$100.
Eligible Cardholder charges a total of S$9,000 in Cashback on Foreign Currency Qualifying Transactions during the Promotion Period to his/her Registered Card. Of this S$9,000, S$800 is from Eligible Transactions in accordance with Clause 29.

Yes, 10% Cashback will be awarded based on the total of S$1300 of Eligible Transactions (both cards combine) provided that the cardholder is within the first 5,000 to meet the Minimum Spend criteria of S$9,000 on each of the 2 registered Cards. However, the Cashback amount awarded will be capped at S$100.
Eligible Cardholder charges a total of S$9,000 in Cashback on Foreign Currency Qualifying Transactions during the Promotion Period to his/her Registered Card. None of the transactions are Eligible Transactions.

 

No Cashback because the Eligible Cardholder may have met the Cashback on Foreign Currency Transaction Minimum Spend criteria but there is no Eligible Transaction.

 

 

  1. All Eligible Transactions and Cashback on Foreign Currency Qualifying Transactions must be charged to the same Registered Card, and there can be no combining of Cashback on Foreign Currency Qualifying Transactions transacted on different Registered Cards into one Registered Card to satisfy the Cashback on Foreign Currency Transaction Minimum Spend and also no combining of Eligible Transactions transacted on different Registered Cards into one Registered Card. The Bank is not responsible for any failure or delay in the transmission of the transactions by any party including but not limited to Mastercard®/Visa acquiring merchants, merchant establishments, or any telecommunication provider.
  2. Eligible Cardholders who have qualified to receive the Cashback will be notified by SMS no later than 15 February 2018. Cashback awarded under the Cashback Promotion will be credited to the credit card account of the Registered Card by 15 February 2018. If the Eligible Cardholder has more than one Registered Card and aggregated the amounts of Cashback on Foreign Currency Qualifying Transactions from his/her Registered Cards, the Cashback will be credited to the credit card account of only one of the Registered Card with the highest Cashback on Foreign Currency Qualifying Transactions.

General

  1. No payment or compensation whether in cash, credit or kind shall be made for any uncollected, lost, misplaced, defaced, stolen or damaged Gift.
  2. The Bank reserves the right to replace or substitute any Gift with any item of equivalent or similar value, without prior notice or reason (and the Bank shall not be obliged to disclose its reason).
  3. Except for death or personal injury caused by the negligence of the Bank, to the fullest extent permitted by law, the Bank and members of the Bank’s group shall have no liability in respect of, and will be indemnified from and against, any liability, loss, claim, damage or costs of any kind (including legal costs) to any person or entity, in whole or in part, directly or indirectly, whether by reason of the acceptance, possession, use or misuse of a Gift.
  4. The Gift is provided by third party merchant(s) who are not participants or sponsors of the Promotion. The Bank is not an agent of such merchant(s). The Bank makes no representation or warranty as to the Gift or the quality of any goods and services provided by the merchant(s). Any dispute about the quality and condition of the Gift is to be resolved directly with the merchant(s). The Bank is not obliged to assist or act on the Eligible Cardholder’s behalf in communicating with the merchant(s).
  5. In the event that the Eligible Cardholder terminates his/her banking relationship with the Bank within 6 months of the expiry of the Promotion Period, the Bank further reserves the right to recover the whole or any part of the Gift, Prize(s) or Cashback given to you under this Promotion. At the time of redemption of a Gift, Prize(s) or Cashback, the Registered Card account must be valid (i.e. must not be suspended, cancelled and/or terminated), in good standing, and conducted in a proper and satisfactory manner, as determined by the Bank in its sole and absolute discretion (and the Bank shall not be obliged to disclosed its reason), failing which, the Gift, Prize(s) or Cashback will be forfeited and the Bank shall also be entitled to recover the whole or any part of the Gift, Prize(s) or Cashback (or such equivalent value) given to you.
  6. The following transactions charged to a Registered Card will not be considered as Qualifying Transactions:
    1. Insurance premiums, including premiums for investment-linked policies, charged to the Registered Card;
    2. Bill payments (Examples of bill payment merchants include but are not limited to Telecommunications and utilities providers such as Starhub, Singtel and M1, Singapore Power);
    3. Any payment via AXS network;
    4. Any payment via SAM network;
    5. Payments to government agencies which include but not limited to Land Transport Authority, Housing Development Board, Inland Revenue Authority of Singapore, Public Utilities Board, Immigration & Checkpoints Authority and the Ministry of Manpower;
    6. Income tax payments;
    7. EZ-Link cards transactions;
    8. TransitLink transactions;
    9. Any transactions pertaining to Merchant Category Codes 6211 (Security Brokers/Dealers) and 7995 (Gambling/Lotto)
    10. Balance transfers to the Registered Card, cash advances from the Registered Card, purchases via NETS and ongoing instalment payments;
    11. Any fees and charges (including annual fees, interest charges, cheque processing fees, administrative fees, cash advance fees, finance charges and/or late payment charges and other miscellaneous fees and charges) charged to the Registered Card;
    12. Any amount charged to the Registered Card during the Promotion Period that is subsequently cancelled, voided or reversed; and
    13. Balance owing on the Registered Card account from other months.
  7. For new retail transactions charged to the Registered Card during the Promotion Period which are successfully converted into monthly instalments, either:
    1. At the point of sale by tie up merchants, the monthly instalment amount (and not the total amount charged for that transaction); or
    2. At a later date by us, the total amount charged (and not the converted monthly instalment amount),

will be considered as a Qualifying Transaction provided such transaction is successfully posted during the Promotion Period.

  1. Qualifying Transactions charged to supplementary cards to a Registered Card’s account will be counted towards the calculation of an Eligible Cardholder’s Spend Amount for the purposes of this Promotion.
  2. For non-Singapore dollar transactions charged to the Registered Card, the transaction amount posted in the Eligible Cardholder’s Registered Card account (which is inclusive of the exchange rate conversion and commission, if any) will be considered as the amount for the purpose of determining the Registered Card’s Spend Amount.
  3. The Bank is not responsible for any failure or delay in the transmission of any transaction by any party, including but not limited to acquiring merchants, merchant establishments, or any telecommunication provider.
  4. The Bank reserves the right to vary, modify, add or delete any of these terms and conditions, including terminating, shortening, extending or withdrawing the Promotion, without prior notice or reason (and the Bank shall not be obliged to disclose its reasons).
  5. Without prejudice to clause 39, in the event the Bank has determined (in the Bank’s sole and absolute discretion) that an Eligible Cardholder has irregularly or wrongly redeemed the Gift, Prize(s) or Cashback from the Bank, or where the Bank has reasonable grounds to believe or knowledge of subsequent events which would mean that the Eligible Cardholder would not have been entitled to redeem the Gift, Prize(s) or Cashback (including but not limited to where any Qualifying Transaction on a Registered Card is reversed or refunded), the Bank reserves the right to claw back the Gift, Prizes(s) or Cashback or to deduct the value of the Gift, Prizes or Cashback from the Eligible Cardholder’s account(s) with the Bank (whichever the case may be).
  6. The Bank reserves the right to determine at its sole and absolute discretion all matters arising out of or in connection with the Promotion, including an Eligible Cardholder’s eligibility and the applicable criteria. The Bank’s determination of all matters relating to this Promotion shall be final, conclusive and binding and, no appeal or objection on any grounds will be entertained (and the Bank shall not be obliged to disclose its reason).
  7. In the event of any inconsistency between these terms and conditions and any brochures, marketing or promotional materials relating to the Promotion, these terms and conditions shall, to the extent of such inconsistency, prevail.
  8. Please read these terms and conditions together with our Customer Terms, Credit Card Terms and any other product terms that may be applicable in conjunction with this Promotion (collectively, “Other Terms”). If there are any inconsistencies between these terms and the Other Terms, these terms prevail only to the extent of such inconsistencies.
  9. A person who is not a party to the Promotion Terms and Conditions has no rights under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of the Promotion Terms and Conditions.
  10. The Promotion Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of Singapore and you agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
