Christmas 2019 Promotion Terms and Conditions

Eligibility

  1. The Christmas 2019 Promotion (“Promotion”) is available from 15 November 2019 to 31 December 2019 (both dates inclusive) (“Promotion Period”). The Promotion is open to all principal cardholders of credit cards issued by Standard Chartered Bank (Singapore) Limited (each a “Card”, collectively “Cards”). For the purposes of this Promotion, each principal cardholder of a Card shall be referred to as an “Eligible Cardholder”, and collectively such cardholders shall be referred to as the “Eligible Cardholders”. By participating in the Promotion, Eligible Cardholders agree to be bound by these Terms and Conditions.
  2. The Promotion comprises the following:
    1. the Spend & Be Rewarded Promotion (“Spend & Be Rewarded Promotion”); and
    2. the Santa’s Workshop Promotion (“Santa’s Workshop Promotion”).
  1. Unless otherwise stated, the Promotion is not valid with other offers, discounts, rebates, vouchers, privileges or promotions. The Promotion is valid in conjunction with the Standard Chartered Caltex 2019 Promotion (the terms and conditions of which can be found here), the Standard Chartered Abecha Esso Fleet Card Promotion (the terms and conditions of which can be found here), and The Good Life® Programme (the individual merchant and general terms and conditions of which can be found here).
  2. For the avoidance of doubt, for an Eligible Cardholder to be eligible for this Promotion, his/her Card account must be valid (i.e. must not be suspended, cancelled and/or terminated, in good standing, and conducted in a proper and satisfactory manner, as determined by Standard Chartered Bank (Singapore) Limited (“Bank” or “we”) in its sole and absolute discretion (and the Bank shall not be obliged to disclose its reason)) from 15 November 2019 to 28 February 2020 (both dates inclusive).

Participation

  1. To participate in the Promotion, Eligible Cardholders must successfully register during the registration period from 13 November 2019 to 29 December 2019 (both dates inclusive) (“Registration Period”) by sending an SMS in the format set out in Clause 7 below. 2 calendar days from the time the Bank receives such an SMS will be required for successful registration for the Promotion.
  2. The Bank will not accept any registration for the Promotion that:
    1. is before and/or after the Registration Period; and/or
    2. is not in the prescribed format (as set out at Clause 7 below).

All such registrations will be considered by the Bank to be invalid and/or void, and the Bank’s determination shall be final and conclusive.

  1. For the purposes of registering for the Promotion, all SMSes must be composed in the following format:

“XMAS19”
(Example: XMAS19)
The composed SMS must be sent to 77222 (if the Eligible Cardholder is sending the SMS when he/she is in Singapore) or +65 8318 4584 (if the Eligible Cardholder is sending the SMS when he/she is not in Singapore) from the Eligible Cardholder’s mobile number that has been registered with the Bank (“Bank Registered Mobile Number”). All SMSes which are not in this prescribed format, sent to an incorrect number, or sent from a non-Bank Registered Mobile Number will not be accepted and will be considered by the Bank to be invalid and/or void, and the Bank’s determination shall be final and conclusive.

  1. An acknowledgement of successful registration for the Promotion will be sent to the Eligible Cardholder’s Bank Registered Mobile Number. Upon successful registration for the Promotion, all of the Eligible Cardholder’s validly existing Cards (i.e. not suspended, cancelled and/or terminated) which are in good standing, and conducted in a proper and satisfactory manner, as determined by the Bank, will be registered for the Promotion (such successfully registered card(s) hereinafter referred to as a “Registered Card” and the cardholder of such Registered Card, a “Registered Cardholder”).
  2. Registered Cardholders who have changed or updated their Bank Registered Mobile Number will have to re-register for the Promotion using their new Bank Registered Mobile Number. Failure to re-register will mean that the Eligible Cardholder will not be eligible for the Promotion.
  3. The speed and reliability of service of the Eligible Cardholder’s internet and/or mobile connection is dependent solely on his/her respective internet and/or mobile service providers. The Bank is not and will not be responsible or liable in any manner whatsoever for any delay or failure in the transmission or receipt of any SMS, or any failure to successfully register resulting from the same. Eligible Cardholders shall be solely responsible for all fees and charges imposed by their service providers in relation to the registration for the Promotion.
  4. By registering for and participating in the Promotion, the Eligible Cardholder consents to the use of his/her personal data for marketing purposes, including but not limited to the use of his/her telephone number and email address to contact him/her about products and promotions offered by the Bank from time to time via telephone, SMS or Electronic Direct Mail.

Spend & Be Rewarded Promotion Mechanics

  1. For the purposes of the Spend & Be Rewarded Promotion, “Spend & Be Rewarded Qualifying Transactions” are retail transactions charged by a Registered Cardholder that:
    1. have transaction dates falling within the Promotion Period;
    2. have been successfully posted to the Registered Card account during the Promotion Period; and
    3. are not excluded transactions (as set out in Clause 30 below).
  2. The first 1,000 Registered Cardholders to charge S$20,000 in Spend & Be Rewarded Qualifying Transaction(s) during the Promotion Period, aggregated across all of his/her Registered Card(s) (“Minimum Spend”), will receive a S$500 cashback (“Gift”).
  3. Each Registered Cardholder is only eligible for a maximum of one (1) Gift. For the avoidance of doubt, the maximum amount of cashback that may be awarded to each Registered Cardholder pursuant the Spend & Be Rewarded Promotion is capped at S$500.
  4. Registered Cardholders who have qualified to receive the Gift will be notified by SMS no later than 28 February 2020. The SMSes will be sent to the relevant Registered Cardholder’s Bank Registered Mobile Number to inform them that the cashback under the Spend & Be Rewarded Promotion has been credited to their Registered Card account. The details of the cashback amount will be reflected in the relevant Registered Cardholder’s next Credit Card Statement of Account from 28 February 2020.
  5. Gifts awarded under the Spend & Be Rewarded Promotion will be credited to the Registered Cardholder’s Registered Card account which has the highest cumulative Spend & Be Rewarded Qualifying Transactions (“Highest Amount”) by 28 February 2020. In the event a Registered Cardholder has two or more Registered accounts with the Highest Amount, the Gift will be credited to the Registered Card account with the earlier account opening date.

Santa’s Workshop Promotion – Promotion Mechanics

  1. To qualify for the Santa’s Workshop Promotion, Registered Cardholders must charge a single retail transaction to a Registered Card that:
    1. is of an amount of S$150 or more;
    2. has a transaction date falling within the Promotion Period;
    3. has been successfully posted to a Registered Card account during the Promotion Period; and
    4. is not an excluded transaction (as set out in Clause 30 below);

(each such transaction fulfilling all limbs of this Clause 17 hereinafter referred to as a “Santa’s Workshop Qualifying Transaction”).

  1. The first 180,000 Santa’s Workshop Qualifying Transactions (each a “Winning Transaction”) during the Promotion Period will each be randomly assigned a unique URL by an automated computerised system. A SMS containing this unique URL (“Santa’s Workshop SMS”) will be sent to the Registered Cardholder’s Bank Registered Mobile Number when such Santa’s Workshop Qualifying Transaction is a Winning Transaction. For the avoidance of doubt, the Santa’s Workshop Promotion is limited to the first 180,000 Santa’s Workshop Qualifying Transactions and SMSes will only be sent to the Registered Cardholders of the first 180,000 Santa’s Workshop Qualifying Transactions.
  2. For the purposes of the Santa’s Workshop Promotion, amounts charged to a Card before registration for the Promotion is successfully completed will not be considered as Santa’s Workshop Qualifying Transactions. The table below illustrates when an Eligible Cardholder’s registration for the Promotion will be successfully completed depending on the respective date that his/her SMS (which fulfils clause 7 above) is received by the Bank, and whether retail transactions charged to his/her Card will be considered as Santa’s Workshop Qualifying Transactions:

Eligible Cardholder sends such a SMS on 19 November 2019 (Tuesday) and the Bank receives this SMS on 19 November 2019. Registration will only take effect from 21 November 2019 (Thursday) (inclusive of this date).

 

For SMSes (which fulfil clause 7 above) the Bank receives between 13 November 2019 12:00am and 29 December 2019 11:59pm, there will be a 2 calendar day period for processing of the registration for the Promotion.

Registered Cardholder’s retail transactions charged to his/her Registered Card from 21 November 2019 12:00am onwards and which fulfil Clause 17 above will be considered as Santa’s Workshop Qualifying Transactions.
The Bank receives such a SMS after the end of the Registration Period i.e. after 29 December 2019 Not applicable. The SMS was received outside of the Registration Period. Eligible Cardholder’s retail transactions charged to his/her Card(s) will not be considered as Santa’s Workshop Qualifying Transactions

 

  1. Each Registered Cardholder is eligible for 1 unique URL sent via 1 SMS for every Winning Transaction made. A Registered Cardholder can only receive a maximum of 3 unique URLs per day notwithstanding that the Registered Cardholder may have made more than 3 Winning Transactions in a day. If the Registered Cardholder makes more than 3 Winning Transactions in a day, the Registered Cardholder will only receive the unique URLs for the first 3 Winning Transactions which occurred on the same day. For the avoidance of doubt, once the Bank has sent a Registered Cardholder 3 Santa’s Workshop SMSes in a day, the Registered Cardholder will no longer be eligible to participate in the Santa’s Workshop Promotion for any additional Santa’s Workshop Qualifying Transaction occurring on the same day.

Eligible Cardholder registers by sending a SMS (which fulfils Clause 7 above) on 15 November 2019 and the Bank receives this SMS on the same day. The Eligible Cardholder successfully registers and thereafter makes 3 transactions of S$150 each on 17 November 2019. Registered Cardholder will be sent 3 unique URLs via SMS only if the 3 transactions are amongst the first 180,000 Santa’s Workshop Qualifying Transactions.
Eligible Cardholder registers by sending a SMS (which fulfils Clause 7 above) on 15 November 2019 and the Bank receives this SMS on the same day. The Eligible Cardholder successfully registers and thereafter makes 10 transactions of S$150 each on 17 November 2019. Registered Cardholder will be sent 3 unique URLs via SMS for the first 3 transactions, only if the first 3 transactions are amongst the first 180,000 Santa’s Workshop Qualifying Transactions.

 

Registered Cardholder will not receive more than 3 unique URLs per day.

Eligible Cardholder registers by sending a SMS (which fulfils Clause 7 above) on 15 November 2019 and the Bank receives this SMS on the same day. The Eligible Cardholder successfully registers and thereafter makes 10 transactions of S$130 each on 17 November 2019. Transactions made by the Registered Cardholder will not be considered as Santa’s Workshop Qualifying Transactions as each transaction is less than S$150.

Santa’s Workshop Promotion – Prizes and Prizes Allocation

  1. The Registered Cardholder of each Winning Transaction (“Winning Cardholder”) will win one of the following prizes:
    1. S$2 cashback;
    2. S$3 cashback;
    3. S$5 cashback;
    4. S$8 cashback;
    5. S$10 cashback;
    6. S$15 cashback;
    7. S$20 cashback; or
    8. S$30 cashback,

(each a “Prize” and collectively, “Prizes”).

For the avoidance of doubt, if a Registered Cardholder does not receive any Santa’s Workshop SMS, he/she will not be entitled to any of the Prizes above.

  1. There will be a total of 180,000 Prizes available to be won for the Santa’s Workshop Promotion, in the following quantities:

The Santa’s Workshop Promotion is subject and limited to the availability of the Prizes above.

  1. The Prizes allocated to the Winning Transactions will be chosen by our computer programme designed specifically for the purpose of the Santa’s Workshop Promotion at 9 Changi Business Park Crescent, Standard Chartered Bank @ Changi 2, Singapore 486005. The computer programme will randomly allocate Prizes to Winning Transactions in real time when a Winning Transaction is made.
  2. The random selection and allocation of Prizes to the respective Winning Cardholders of the Winning Transactions will be verified by external auditors. We reserve the discretion to change any of the Prize allocation mechanics without giving prior notice or reason. We may appoint any party as we deem fit as an external auditor for the Prize allocation.
  3. Each Prize will be credited to the relevant Winning Cardholders’ Registered Card account used to charge the corresponding Santa’s Workshop Qualifying Transaction by 28 February 2020. SMSes will be sent to the relevant Winning Cardholder’s Bank Registered Mobile Number to inform him/her that the Prize has been credited to their Registered Card account. The details of the Prize amount will be reflected in the Winning Cardholder’s next Credit Card Statement of Account from 28 February 2020.

General

  1. The Gifts awarded under the Spend & Be Rewarded Promotion, and Prizes awarded under the Santa’s Workshop Promotion (such Gifts and Prizes are to be collectively referred to as “Cashback”) are strictly non-transferable and non-exchangeable for cash or credit or otherwise.
  2. No payment or compensation whether in cash, credit or kind shall be made for any lost, misplaced or stolen Cashback.
  3. The Bank reserves the right to replace or substitute any Cashback with any item of equivalent or similar value, without prior notice or reason (and the Bank shall not be obliged to disclose its reason).
  4. In the event that the Registered Cardholder terminates his/her banking relationship with the Bank within 6 months of the expiry of the Promotion Period, the Bank further reserves the right to recover the whole or any part of the Cashback given to you under this Promotion. At the time of crediting of the Cashback, the relevant Registered Card account must be valid (i.e. must not be suspended, cancelled and/or terminated, in good standing, and conducted in a proper and satisfactory manner, as determined by the Bank in its sole and absolute discretion), failing which, the Cashback will be forfeited and the Bank shall also be entitled to recover the whole or any part of the Cashback (or such equivalent value) given to you.
  5. The following transactions charged to a Registered Card will not be considered as a Spend & Be Rewarded Qualifying Transaction or Santa’s Workshop Qualifying Transaction for the purposes of the Spend & Be Rewarded Promotion and the Santa’s Workshop Promotion respectively:
    1. Insurance premiums, including premiums for investment-linked policies;
    2. Any transactions or bill payments to Telecommunications and utilities providers including but not limited to Starhub, Singtel, M1, and Singapore Power);
    3. Any payment via AXS network;
    4. Any payment via SAM network;
    5. Payments to government agencies which include but not limited to Land Transport Authority, Housing Development Board, Inland Revenue Authority of Singapore, Public Utilities Board, Immigration & Checkpoints Authority and the Ministry of Manpower;
    6. Income tax payments;
    7. Any bill payment made using SC EasyBill bill payment programme;
    8. Any top-ups or payment of funds to any prepaid cards (with exception of EZ-Reload), prepaid accounts, digital wallets including but not limited to Grab, Singtel Dash, WorldRemit Singapore, YouTrip or any other accounts as the bank may specify from time to time;
    9. EZ-Link cards transactions;
    10. TransitLink transactions;
    11. Any transactions pertaining to Merchant Category Codes 6211 (Security Brokers/Dealers) and 7995 (Gambling/Lotto);
    12. Balance transfers (or funds transfers), instalment loans and cash advances, purchases via NETS and ongoing instalment payments;
    13. Any fees and charges (including annual fees, interest charges, cheque processing fees, administrative fees, cash advance fees, finance charges and/or late payment charges and other miscellaneous fees and charges) charged to any of the Bank issued credit cards of the Registered Cardholder;
    14. Any amount charged to the any of the Bank issued credit cards of the Registered Cardholder during the Promotion Period that is subsequently cancelled, voided or reversed; and
    15. Balance owing on the Registered Cardholder’s credit card accounts from other months.

For the purposes of these Christmas 2019 Promotion Terms and Conditions, each Spend & Be Rewarded Qualifying Transaction and Santa’s Workshop Qualifying Transaction shall also be referred to as a “Qualifying Transaction”.

  1. For retail transactions charged during the Promotion Period to a Registered Card which are successfully converted into monthly instalments:
    1. at the point of sale by tie up merchants, the monthly instalment amount (and not the total amount charged for that transaction); or
    2. at a later date by the Bank, the total amount charged (and not the converted monthly instalment amount), will be used by the Bank to determine the whether the Minimum Spend has been made by a Registered Cardholder under the Spend & Be Rewarded Promotion, and/or if the Registered Cardholder has made a Santa’s Workshop Qualifying Transaction under the Santa’s Workshop Promotion, provided such transaction does not fall within any of the exclusions set out in Clause 30 above.
  2. For all non-Singapore dollar Qualifying Transactions charged to the Registered Card, the transaction amount(s) posted in the Registered Cardholder’s credit card statement (inclusive of the exchange rate conversion and commission, if any) will be used by the Bank to determine whether the Minimum Spend has been made by a Registered Cardholder under the Spend & Be Rewarded Promotion, and/or if the Registered Cardholder has made a Santa’s Workshop Qualifying Transaction under the Santa’s Workshop Promotion.
  3. All Qualifying Transactions must be charged and posted to the Registered Card within the Promotion Period. We are not responsible for any failure or delay in the transmission of the transactions by any party including but not limited to acquiring merchants, merchant establishments, or any telecommunication provider.
  4. Qualifying Transactions charged to and posted to the card accounts of all supplementary cards linked to a Registered Card will be treated as a Qualifying Transaction made by the principal Registered Cardholder on the relevant principal Registered Card for the purposes of the Promotion.
  5. The Bank may vary, modify, add, delete or otherwise revise any of the Terms and Conditions governing the Promotion or modify, terminate, withdraw, extend, suspend or shorten the Promotion at any time at the Bank’s sole and absolute discretion, with or without prior notice or reason (and the Bank shall not be obliged to disclose its reasons).
  6. The Bank reserves the right to determine at its sole and absolute discretion all matters arising out of or in connection with the Promotion. The Bank’s determination of all matters relating to the Promotion shall be final and conclusive and no correspondence will be entertained.
  7. Without prejudice to Clause 29, in the event the Bank has determined (in the Bank’s sole and absolute discretion) that a Registered Cardholder is not eligible to receive the Cashback or to participate in the Promotion or has irregularly or wrongly redeemed the Cashback, or where the Bank has knowledge of subsequent events which would mean that the Registered Cardholder would not have been entitled to redeem the Cashback (including but not limited to where the charges used to meet the relevant minimum spend(s) were reversed or refunded), the Bank reserves the right to claw back the Cashback or to deduct its value (or such other amount as it deems fit) from the Registered Cardholder’s account(s) with the Bank.
  8. In the event of any inconsistency between the Promotion Terms and Conditions and any brochures, marketing or promotional materials relating to the Promotion, these Promotion Terms and Conditions shall prevail to the extent of such inconsistency.
  9. Except for death or personal injury caused by the negligence of the Bank, to the fullest extent permitted by law, the Bank and members of the Bank’s group shall have no liability in respect of, will be indemnified from and against, and/or you hereby agree to release and hold the Bank and members of the Bank’s group harmless for, any expenses, costs of any kind (including legal costs), liability, loss (whether foreseeable or not), claim or damage, directly or indirectly, suffered, incurred (whether in common law or equity), arising from or in connection with your acceptance, possession, use, misuse and/or enjoyment of the Cashback and/or this Promotion.
  10. These Promotion Terms and Conditions are to be read together with our Customer Terms and Credit Card Terms and any other product terms that may be applicable in conjunction with the Promotion (collectively “Other Terms“). In the event of any inconsistency between these terms and the Other Terms, these terms prevail only to the extent of such inconsistency.
  11. A person who is not a party to these Promotion Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of the Promotion Terms and Conditions.
  12. These Promotion Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of Singapore and you agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
