1. The Health Rewards – Standard Chartered Marathon Promotion (“Marathon Promotion”) is available from 24 October 2019 to 12 November 2019, both dates inclusive (the “Marathon Promotion Period”) and is jointly organized by Standard Chartered Bank (Singapore) Limited (the “Bank”) and Allianz Global Corporate & Specialty SE Singapore Branch (“Allianz”).
2. By participating in this Promotion, you agree to be bound by these terms and conditions (“Marathon Promotion T&Cs”). Please read these Marathon Promotion T&Cs in conjunction with the Health Rewards Promotion Terms and Conditions (full terms and conditions may be accessed at https://www.sc.com/sg/terms-and-conditions/sg-healthrewards/). If there is any inconsistency between these Marathon Promotion T&Cs and the Health Rewards Promotion Terms and Conditions, these Marathon Promotion T&Cs prevail only to the extent of such inconsistency. Unless otherwise defined herein, italicized terms shall bear the meaning as ascribed to them in the Health Rewards Promotion Terms and Conditions.

Eligibility & Redemption

3. With the exception of Clause 3(a), where you (“Eligible Customer” or “you”) have met all the other requirements set out in Clause 3 of the Health Rewards Promotion Terms and Conditions during the Promotion Period, you shall be eligible to receive one (1) complimentary Standard Chartered Marathon Singapore 2019 race entry for one (the “Gift”), valid for all race categories except for Ekiden.

4. Further terms and conditions on the redemption of the Gift (which shall be deemed to be incorporated herein) and a unique registration URL will be sent to your registered email address with Allianz within 5 Business Days from the date of issue of the Eligible Policy under the Health Rewards Promotion. The Gift must be redeemed in accordance with these terms and conditions and the instructions stated in the redemption email.
5. Further to Clause 4, the Eligible Customer must redeem the Gift by 22 November 2019 (inclusive of such date), failing which the Gift will be forfeited. No payment or compensation whether in cash, credit or kind shall be made for any unused, lost, misplaced, defaced, stolen or damaged Gift.
6. The Gift is strictly non-assignable, non-redeemable and non-exchangeable for cash or credit or otherwise, whether in full or in part. The Bank reserves the right to replace or substitute the Gift with any item of similar or equivalent value, at any time without prior notice or reason at its sole and absolute discretion (and the Bank shall not be obliged to disclose its reasons).
7. The Gifts will be issued while stocks last on a first-come-first-serve basis and is limited to the first 50 Eligible Customers who successfully redeem their Gift. Each Eligible Customer is limited to receive a maximum of one (1) Gift, regardless of the number of accounts you open with the Bank or the number or value of Eligible Policy(ies) and Eligible Product(s) purchased under the Health Rewards Promotion.
8. The Gift is provided by third party merchants who are not participants or sponsors of the Marathon Promotion. The Bank is not an agent of the merchants (and vice versa) and makes no representation or warranty as to the quality, value, merchantability, condition or fitness for purpose or other implied terms or conditions with respect to the Gift and accepts no liability for the Gift. Any dispute about quality, value, performance or condition of the Gift is to be resolved directly between the Eligible Customer and the relevant merchant. In case of any disputes, the decision of the Bank and/or the respective merchants shall be final and conclusive. The Bank is not obliged to assist or act on your behalf in communicating with the merchants supplying the Gift for any reason. You accept the Gift as it is and subject to any terms and conditions the merchants may impose.
9. The Bank and Allianz reserve the right to decline to award the Gift, or to recover or debit the value of the Gift (as determined by the Bank in its sole and absolute discretion) from you, including from your account(s) with the Bank, without notice to you, under this Marathon Promotion, in the event that the Bank and Allianz determine that: (a) your relevant insurance policy(ies) with Allianz have been cancelled or terminated or where any terms and conditions set out in these policy(ies) was not complied with, (b) any of the eligibility requirements set out above and in Clause 3 (except for Clause 3(a)) of the Health Rewards Promotion Terms and Conditions was not or has not been complied with but the Gift has been redeemed, or (c) any of the requirements or the terms of the banking agreement between you and the Bank has not been complied with, including but not limited to the following:
   1. where you have acted fraudulently or dishonestly;
   2. where you have conducted yourself in bad faith or otherwise in an inappropriate manner to gain an unfair advantage against the Bank;
   3. upon the occurrence of any event giving rise to a right for the Bank to suspend or terminate any (or all) of the banking agreement between you and the Bank for a product, as set out at Clause 29.3 and Clause 33 of the Bank’s Customer Terms and elsewhere in the banking agreement between you and the Bank.

You further agree that, under any of the circumstances stated above, the Bank and Allianz are not obliged to substitute the Gift with a gift or account credit of lower value.

General

10. Unless otherwise stated or permitted by the Bank, this Marathon Promotion is not valid with other promotions, discounts, offers, vouchers, rebates or privileges. This Marathon Promotion is valid in conjunction with the Bank’s Health Rewards Promotion.
11. The Bank reserves the right to, at any time in its sole and absolute discretion, vary, modify, add or delete or otherwise revise any of these Marathon Promotion T&Cs, including terminating, extending, suspending, shortening or withdrawing the Marathon Promotion, without prior notice or reason (and the Bank shall not be obliged to disclose its reasons). You understand and agree to be bound by any such variation.
12. The Bank reserves the right to determine at its sole and absolute discretion all matters arising out of or in connection with the Marathon Promotion, including but not limited to your eligibility for the Marathon Promotion and/or the Gift. The Bank’s determination of all matters relating to the Marathon Promotion shall be final and binding, and no correspondence will be entertained (and the Bank shall not be obliged to disclose its reasons).
13. Except for death or personal injury caused by the negligence of the Bank, the Bank shall not be responsible for, and you hereby agree to release and hold the Bank harmless for, any expenses, loss (whether foreseeable or not), claim or damage suffered or incurred (whether in common law or equity) arising from or in connection with, directly or indirectly, this Marathon Promotion, your redemption of and/or enjoyment of the Gift and/or the Standard Chartered Marathon Singapore 2019, to the fullest extent permitted by law.
14. In the event of any inconsistency between these Marathon Promotion T&Cs and any brochures, marketing or promotional materials relating to the Marathon Promotion, these Marathon Promotion T&Cs shall, to the extent of such inconsistency, prevail.
15. A person who is not a party to these terms and conditions has no rights under the Contracts (Rights of Third Parties) Act (Cap.53B) to enforce any of these Marathon Promotion T&Cs.
16. These Marathon Promotion T&Cs are governed by and shall be construed in accordance with the laws of the Republic of Singapore and you agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
