Summary of Changes to Customer Terms

We will be amending our Customer Terms with effect from 19 January 2024. We will be updating 28.5 Reversals.

  1. 5 If there is a mistake in our transaction records, statements or other communication to you (whether in paper, electronic, data or other form, for example an online portal or mobile app) and you know of or ought to know of such a mistake (whether because it is not consistent with your instructions to us or your holdings with us, or for any other reason):
  • you must notify us immediately upon becoming aware of such a mistake:
  • you must not act in any manner to make use of that mistake to your benefit; and
  • if you receive any payment, whether in cash or any other form of asset, in relation to such a mistake, you must not (and must not attempt to) assign, dispose of, encumber, sell, transfer, utilise, withdraw or otherwise deal with such payment, and must immediately return that to us.

In the event that you do not do so, you shall be liable to:

  • account for all profits that you may have made in connection with your breach; and
  • pay for all fees, charges and losses that we may have suffered in connection with your breach, including but not limited to any fees, charges and losses that we may have suffered in providing our Services to you and/or to our other customers.
