Christmas 2018 Foreign Currency Cashback Promotion Terms and Conditions

  1. The Christmas 2018 Foreign Currency Cashback Promotion (the “Promotion”) is available from 1 November to 31 December 2018 (both dates inclusive) (the “Promotion Period”). By participating in this Promotion, Selected Cardholders (as defined in Clause 3a below) agree to be bound by these terms and conditions.
  2. Under this Promotion, Selected Cardholders can get 10% cashback (“Cashback”) when they meet the criteria as set out in Clauses 10 and 11, subject to the terms below.
  3. The eligibility criteria:
    1. The Promotion is exclusive to the principal cardholder who has received either an SMS and/or Electronic Direct Mailer (“Communication”) from Standard Chartered Bank (Singapore) Limited (“Bank”) about this Promotion containing the URL to these terms and conditions (“Selected Cardholder”). For the avoidance of doubt, supplementary cardholders of Eligible Cards are not eligible for this Promotion.
    2. To be eligible to participate in the Promotion, a Selected Cardholder must hold at least one credit card issued by the Bank that must be validly existing (i.e. must not be suspended, cancelled or terminated), in good standing, and conducted in a proper and satisfactory manner at all times, including the time of crediting any Cashback to any such card account that the Selected Cardholder holds, as determined by the Bank in its sole and absolute discretion (“Eligible Card”).

Participation

  1. To participate in the Promotion, Selected Cardholders must:
    1. Successfully register for the Promotion from 1 November to 31 December 2018 (both dates inclusive) (“Registration Period”) by sending an SMS in the manner set out in Clause 6 (“SMS Registration“).
    2. The Registered Card(s) (defined in Clause 7) must be eligible for the Promotion (see Clauses 3a and 3b above for eligibility requirements);
  1. The Bank will not accept any:
    1. Attempts to register before and/or after the Registration Period; and/or
    2. Registrations that are not in the prescribed format (as set out at Clause 6 below);
  1. All such registrations will be considered by the Bank to be invalid and/or void, and the Bank’s determination shall be final and conclusive; For SMS Registration, all SMSes must be composed in the following format:
    “FCY”
    (Example: FCY)
    The composed SMS must be sent to 77222 from the Selected Cardholder’s mobile number that was registered with the Bank (“Bank Registered Mobile Number”). All SMSes which are not received from the Selected Cardholder’s Bank Registered Mobile Number, and which are not composed in this prescribed format, sent to an incorrect number or sent from a non-Bank Registered Mobile Number will not be accepted and will be considered by the Bank to be invalid and/or void, and the Bank’s determination shall be final and conclusive.
  2. An acknowledgement of successful Registration will be sent to the Selected Cardholder’s Bank Registered Mobile Number. Upon successful Registration, all of the Eligible Cardholder’s validly existing Cards (as set out in Clause 3b) will be registered for the Promotion. (such successfully registered card(s) hereinafter referred to as a “Registered Card”, the cardholder of such Registered Card, a “Registered Cardholder” and the registration process referred to as “Registration”).
  3. Registered Cardholders who have changed or updated their Bank Registered Mobile Number will have to re-register for the Promotion under the new number. Failure to re-register will mean that cardholder will not be eligible for the Promotion.
  4. Eligible Cardholders need only register once by SMS Registration within the Registration Period to participate in the Promotion, except where Registered Cardholders have changed or updated their Bank Registered Mobile Number for which Clause 8 above would apply.

Promotion Mechanics

  1. Qualifying Foreign Currency transactions (“Eligible Transactions”) are foreign currency (non-Singapore Dollar) spends charged to the Eligible Card account(s) (which, for the avoidance of doubt, must be made in foreign currency), provided that such transaction is not a transaction made on the Grab app or Grabfood app. For the avoidance of doubt, transactions made on the Grab app or Grabfood app will not be considered as Eligible Transactions for this Foreign Currency Cashback Promotion. Purchases in Singapore but charged in foreign currency which are not transactions made on the Grab app or Grabfood app will be considered as Eligible Transactions for this Foreign Currency Cashback Promotion.
  2. To qualify for the Cashback, Selected Cardholders must be one of the first 15,000 cardholders to successfully register and meet the minimum spend requirement of S$1,000 in foreign currency equivalent (“Minimum Spend”) in his/her total spend on Eligible Transactions (i.e., qualifying non-Singapore Dollar spends) within the Promotion Period (based on transaction date) across all of the Selected Cardholder’s Registered Card(s). For foreign currency transactions charged to the Registered Card(s), the transaction amount posted in the Selected Cardholder’s credit card statement (inclusive of the exchange rate conversion and commission, if any) will be considered as the amount for the purpose of determining the Minimum Spend.
  3. For the avoidance of doubt, the maximum cashback each Selected Cardholder is eligible to receive under this Promotion is capped at S$100.
  4. Selected Cardholders who have qualified to receive the Cashback will be notified by SMS no later than 15 February 2019.
  5. Any Cashback awarded under this Promotion will be credited to the Registered Card account with the highest amount transacted in Qualifying Foreign Currency transactions by 15 February 2019.

General

  1. Unless otherwise stated, the Promotion is not valid with other offers, discounts, rebates, vouchers, privileges or promotions. The Promotion is valid in conjunction with the Christmas 2018 Promotion (the terms and conditions of which can be found here), , the Standard Chartered Caltex 2018 Promotion (the terms and conditions of which can be found here) and The Good Life® 2018 Promotion (the individual merchant and general terms and conditions of which can be found here).
  2. The Bank is not responsible for any failure or delay in the transmission of the transactions by any party, including but not limited acquiring merchants, merchant establishments, or any telecommunication provider.
  3. Foreign Currency spends that are non-Singapore Dollars and which satisfy Clause 10 charged to supplementary cards to Eligible Card account will be counted towards the Eligible Transactions for the purposes of the Promotion.
  4. The Bank reserves the right to revise these terms and conditions, modify or withdraw the Promotion at any time without prior notice or reason including terminating, shortening, extending or withdrawing the Promotion and/or substituting the Cashback with any other item (which may or may not be of equivalent or similar value), without prior notice or reason.
  5. The Bank is not an agent of any merchant or service provider or vice versa.
  6. The speed and reliability of service of the Selected Cardholder’s internet and/or mobile connection is dependent solely on his/her respective internet and/or mobile service providers. The Bank is not and will not be responsible or liable in any manner whatsoever for any delay or failure in the transmission or receipt during the Registration, or any failure to complete Registration resulting from the same. Selected Cardholder shall be solely responsible for all fees and charges imposed by their service providers in the SMS registration (as the case may be).
  7. By registering and participating in the Promotion, the Selected Cardholder consents to the use of his/her personal data for marketing purposes, including but not limited to the use of his/her telephone number to contact him/her about products and promotions offered by the Bank from time to time via telephone, SMS or multimedia messaging. Such consent will also prevail even if the Selected Cardholder is registered or subsequently registers his/her contact information with the national Do Not Call Registry.
  8. The Cashback is non-transferable, non-assignable and non-exchangeable for cash or credit or otherwise.
  9. The Bank reserves the right to determine at its sole and absolute discretion all matters arising out of or in connection with the Promotion, including the Selected Cardholder’s eligibility for the Cashback and/or the Promotion. The Bank’s determination of all matters relating to this Promotion shall be final and binding, and no correspondence will be entertained.
  10. In the event of any inconsistency between these terms and conditions and any brochures, marketing or promotional materials relating to the Promotion, these terms and conditions shall, to the extent of such inconsistency, prevail.
  11. In the event the Bank has determined that a Selected Cardholder has irregularly or wrongly redeemed the Cashback from the Bank, or where the Bank has knowledge of subsequent events which would mean that the Selected Cardholder would not have been entitled to redeem the Cashback (including but not limited to where the charges for the Eligible Transaction were reversed or refunded), the Bank reserves the right to claw back the Cashback or to deduct the value of the Cashback from the Selected Cardholder’s account(s) with the Bank. For the purposes of clawing back any part or all of the Cashback, each participant authorizes and consents to the Bank debiting the value of any part or all of the Cashback from any of his/her/their credit card accounts.
  12. Except for death or personal injury caused by the negligence of the Bank, to the fullest extent permitted by law, the Bank accepts no liability for the goods and services provided by any merchant or service provider. In case of any disputes, the decision of the Bank and the respective merchants shall be final.
  13. The Promotion’s terms and conditions are to be read in conjunction with the Bank’s Customer Terms, Credit Card Terms and/or any other product terms that may be applicable in relation to this Promotion (collectively, “Other Terms”). In the event of any inconsistency between these terms and the Other Terms, these terms prevail only to the extent of such inconsistency.
  14. A person who is not a party to these terms and conditions has no rights under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of these terms and conditions.
  15. These terms and conditions are governed and construed in accordance with the laws of Singapore. Any dispute arising out of these terms and conditions shall be referred to the exclusive jurisdiction of the Courts of Singapore.
