      #GSSWithSC Contest Terms and Conditions

      1. The #GSSWithSC Contest (the “#GSSWithSC Contest“) is organised by Standard Chartered Bank (Singapore) Limited (“Standard Chartered” or the “Bank“), in conjunction with the Great Singapore Sale (“GSS”). To enter the #GSSWithSC Contest, you have to meet the participation criteria as set out in Clauses 7 and 8 below.
      2. These terms and conditions govern your participation as an entrant (the “Entrant”) in the #GSSWithSC Contest. You can also view additional applicable terms of use found on the Bank’s website at sc.com/sg/promotions/gss. Note that Facebook (the “Channel”) may impose other applicable terms and conditions. Please read these terms and conditions, as well as any additional applicable terms of use and/or terms and conditions carefully before participating in #GSSWithSC Contest.
      3. By participating in this #GSSWithSC Contest, you agree to be bound by these terms and conditions, including any applicable terms of use found on the Bank’s website at sc.com/sg and the Channel, and you represent and warrant that all details you have provided are true, accurate and complete. Entrants may be asked to verify their Entries (which comprises the Week 1 Entries and the Week 2 Entries, each defined in Clauses 8 and 9 below), if necessary.
      4. By participating in this #GSSWithSC Contest on or after 23 June 2017, you acknowledge that:
        1. these terms and conditions have been amended as of 23 June 2017,
        2. all Entries submitted on or after 23 June 2017 have to comply with the requirements set out in this revised version of the terms and conditions for an Entrant to participate in this #GSSWithSC Contest; and
        3. or the avoidance of doubt, you agree to be bound by the revised version of these terms and conditions on and from 23 June 2017.

      Eligibility & Contest Period 

      1. This #GSSWithSC Contest is held between 31 May 2017 (12:00 hours, Singapore time) and 29 June 2017 (23:59 hours, Singapore time) (both dates inclusive) (the “Contest Period“). Only Entries received by the Bank during the Contest Period are eligible for the #GSSWithSC Contest. In addition, Entries must be posted within the correct corresponding week for each Week in accordance with Clauses 7 and 8 below. Entries posted to a non-corresponding week will not be considered.
      2. This #GSSWithSC Contest is open to all Singaporean citizens and Singaporean Permanent Residents aged 21 and above who have valid and existing Facebook accounts at the time of posting of the Entry and who are not:
        1. the Bank’s staff and employees, employees of the Bank’s subsidiaries, related corporations and affiliates, and/or the immediate family members of such employees; and/or
        2. Staff and employees of the Bank’s service providers, Protocol Pte. Ltd, and Asia PR Werkz Pte Ltd or any other party who helped in the preparation, organisation, planning, promotion, execution of, or is otherwise involved in this #GSSWithSC Contest.

      Participation

      1. To participate in this #GSSWithSC Contest from 31 May to 6 June 2017 (“Week 1”) the following criteria must be met:
        1. You must purchase a gift for yourself using any of your Standard Chartered credit cards during this GSS, and retain all credit card charge slips for verification;
        2. You must take a photo of the items which you purchased using your Standard Chartered credit cards at the Great Singapore Sale (“Week 1 Photo”) and tell us why you deserve this shopping purchase during Week 1, in accordance with Clause 7(c) below; and
        3. You must upload your Week 1 Photo, tell us the answer (“Week 1 Answer”) as to why you deserve this shopping purchase and add the hashtag “#GSSwithSC” in the comment section of the Bank’s Facebook post uploaded on 31 May 2017 (the “Bank’s Week 1 Facebook post”) during Week 1. The Photo, Answer and hashtag should be posted as a single comment on the Bank’s Week 1 Facebook post (the “Week 1 Entry”).
      1. To participate in this #GSSWithSC Contest from 23 June to 29 June 2017 (“Week 2”), the following criteria must be met:
        1. You must take a photo of you and your friends having a great time shopping, dining or travelling during this GSS (“Week 2 Photo”); and
        2. You must upload your Week 2 Photo with a creative caption (“Week 2 Caption”) and add the hashtag “#GSSwithSC” in the comment section of the Bank’s Facebook post uploaded on 23 June 2017 (the “Bank’s Week 2 Facebook post”) during Week 2. The Week 2 Photo, Week 2 Caption and hashtag should be posted as a single comment on the Bank’s Week 2 Facebook post (the “Week 2 Entry”).
      1. Your answer / caption (as applicable) needs to be posted on the correct Bank’s Facebook post and within the correct Week to qualify for the #GSSWithSC Contest. For example, if you post an answer to the Week 1 question on 27 June 2017, your answer will not qualify for the #GSSWithSC Contest in Week 1 or 2.
      2. A submission is deemed posted successfully by the Entrant if it appears as a comment on the Bank’s Facebook Post during the Contest Period. Such Entry has to be remain visible to the public at all times during the Contest Period before it will be considered as the Entrant’s submission of an Entry to this #GSSWithSC Contest and eligible to be considered for the Prize (as defined below) in this #GSSWithSC Contest.
      3. A submission is deemed posted successfully by the Entrant if it appears as a comment on the Bank’s Facebook Post during the Contest Period. Such Entry has to be remain visible to the public at all times during the Contest Period before it will be considered as the Entrant’s submission of an Entry to this #GSSWithSC Contest and eligible to be considered for the Prize (as defined below) in this #GSSWithSC Contest.
      4. For the avoidance of doubt, all Entries must adhere to the Standard Chartered Online interaction guidelines available at http://www.standardchartered.com/_interaction-guidelines/en/index.html. By submitting an Entry, participating in the #GSSWithSC Contest, the Entrant represents and warrants that the Entry and any contents posted by the Entrant on the Channel (“Posted Contents“) will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is unlawful, libellous, racially disparaging, defamatory, obscene, harassing or threatening, and the Entrant further agrees to abide by all rules and guidelines prescribed herein, and the Bank reserves the right to remove or otherwise not publish any post that contravenes any of these rules and guidelines, including but not limited to:
        1. any post, comment, photo and video which contains offensive, aggressive, denigrating, irrelevant or inappropriate language;
        2. any post, comment or photo which veers away from the topic in discussion and/or is otherwise not related to the #GSSWithSC Contest, or which appear to be spam; and/or
        3. any post, comment or photo which may be obscene, defamatory, seditious, blasphemous or otherwise malicious in nature.

      Prizes

      1. 1 winner will be selected for Week 1 and Week 2 from the Entrants that have provided the most creative Week 1 Answer / Week 2 Caption (as applicable). The Bank’s service provider, Asia PR Werkz Pte Ltd, will first select a pool of potential prize winners from all eligible Entries. From this pool, the Bank will select the 1 Entry per relevant Week which has the most creative answer to the question posed in the Bank’s Week 1 Facebook post and the caption in response to the Bank’s Week 2 Facebook post (as the Bank shall determine in its sole and absolute discretion) (collectively “Winners” or individually a “Winner”). There will be a maximum of one (1) Winner for each of Week 1 and Week 2. A Winner who is a Standard Chartered Credit cardholder will receive $100 worth of shopping vouchers while a Winner who is not a Standard Chartered Credit Cardholder will receive $20 worth of shopping vouchers (each known as a “Prize”).
      2. For the purposes of picking a Winner for Week 1, all shortlisted potential Winners for Week 1 would need to produce copies of credit card charge slips to allow the Bank to verify that the purchases were transacted using Standard Chartered Credit Cards. Should the Bank not be able to verify the transaction, the shortlisted potential Winner would not qualify to receive the Prize for Week 1.
      3. The Prize is non-redeemable for cash and/or any other items, and it is non-transferable, non-assignable and non-exchangeable. Each Winner is limited to a maximum of one (1) Prize for the #GSSWithSC Contest.
      4. Any Prizes which are not redeemed will be forfeited. No payment or compensation whether in cash, credit or kind shall be made for any uncollected, lost, misplaced, defaced, stolen or damaged Prize.
      5. All Winners will be notified via a reply (“Reply”) on the specified Entry on Facebook containing their submission and posted by the Bank through the Bank’s Facebook account. Winners will have three (3) working days from the date of posting of the Reply, or in any event until the deadline stipulated in the Reply, to privately message the Bank using his/her Facebook account, providing relevant personal data, information and/or documents, as required by the Bank (including but not limited to providing the Winner’s name, mailing address, NRIC / Passport number and to provide copies of the credit card charge slip for proof of purchase (as stipulated in Clause 14 above). Once the Bank is able to verify the purchase in accordance with these terms and conditions, the Prize will be mailed to the Winner at the mailing address provided. If any Winner fails to reply within the period specified above or provides the Bank with erroneous details, the Bank reserves the right to select another Winner. The Winner is solely responsible for providing updated particulars to the Bank for the purposes of fulfilment of the Prize, and the Bank shall not be liable for any loss arising from any omission, error and/or default attributable to the Winner. All winners will be notified by 21 July 2017.
      6. The Bank reserves the sole and absolute discretion to change the mechanics of the #GSSWithSC Contest without prior notice or reason. The Bank may appoint any independent party as the external auditor for the #GSSWithSC Contest, as it deems fit.
      7. The Bank has the sole and absolute discretion to determine the authenticity, eligibility and/or accuracy of the Entry and its decision will be final and binding on all Entrants, and no correspondence will be entertained whether in relation to the above or otherwise.
      8. The Bank may, in its sole and absolute discretion, to disqualify any Entry which the Bank considers to have been made in breach of these terms and conditions. This includes, but is not limited to, the Entrant’s failure to meet the #GSSWithSC Contest’s eligibility criteria and/or the Entrant’s submission of an Entry which the Bank deems to be obscene, libellous, racially disparaging, defamatory, harassing or threatening or contains any unlawful content.
      9. The Bank is not responsible for any Entry to the Contest that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect or incomplete, for any reason whatsoever, will also not be eligible for the #GSSWithSC Contest.
      10. The Bank is not responsible for any content posted by the Entrants or for any comments made by members of the public in relation to the Entries or the Posted Contents. All opinions and comments expressed by users of the Channel are expressed in their individual capacities and not as representatives of the Bank.
      11. The Bank takes no responsibility and assumes no liability for any user content that any user may post. You are solely responsible for your user content and the consequences of posting and publishing it.
      12. The Bank reserves the right to substitute alternative prizes which may not be of equivalent value at any time by giving notice on the Channel or otherwise notifying the relevant Winners.
      13. By participating in the #GSSWithSC Contest, you consent to and grant the Bank the right to publish and/or broadcast the results of the #GSSWithSC Contest and disclose and publish your information as may be relevant and/or necessary for the fulfillment of the Prize (including name and part of the identification / passport number):
        1. in any major newspaper in Singapore;
        2. over the air via radio shows in Singapore;
        3. on television screens at selected marketing locations in Singapore;
        4. on the Channel; and/or
        5. on the Bank’s websites.
      14. The Winners may be invited to participate in public relations events to generate press coverage for the #GSSWithSC Contest, including without limitation, Winners’ quotations being included in the Bank’s press releases, and Winners’ attendance at prize-giving ceremonies, press conferences, and interviews.

      Intellectual Property

      1. You agree to waive any moral rights in the Entry and/or any image, video, sound file and/or any other media in any format which is embedded in and/or linked by hyperlink or URL text or otherwise in the Entry (the “Media Files”), to the fullest extent possible and any moral rights that a third party may have in respect of the Entry and/or any of the Media Files described above will be so waived.
      2. All promotional images produced by the Bank or any member of the Bank’s Group and associated with the #GSSWithSC Contest, participants, Winners and Prizes will be the property of the Bank. The Bank reserves the right to publicize the names of the Winners on the official websites of any member of the Bank’s Group and such other channels similar to the Channel.

      Data Protection

      1. By participating in the #GSSWithSC Contest and/or otherwise consenting to be a part of the #GSSWithSC Contest:
        1. the Entrant consents to the Bank’s collection, holding, storage, use, processing, transfer, disclosure and/or reporting (whether directly or indirectly) to any relevant third party, of his/her personal data and/or information provided to the Bank, including but not limited to, for the purposes of administering his/her participation, organising and promoting the #GSSWithSC Contest, or otherwise for purposes relating to the #GSSWithSC Contest; and further consents and acknowledges that his/her personal data and/or information (i) will also be processed in line with the Bank’s privacy statement available at sc.com/sg/privacy; and (ii) may be used in accordance with the Bank’s policies, terms and conditions or notices made available by the Bank to him/her from time to time.
        2. the Entrant agrees that any personal information collected by the Bank about the Entrant (as provided or supplied by the Entrant) can be used by the Bank, and also disclosed to, and used by, persons who are involved in operating or promoting the Contest on behalf of the Bank (including the Bank’s service providers, other members of the Bank’s Group and Bank’s Group service providers).
        3. the Entrant consents to the use of his/her personal data for marketing purposes, including but not limited to the use of his/her telephone number to contact him/her about products and promotions offered by the Bank from time to time via telephone, SMS or multimedia messaging. Such consent will also prevail even if the Entrant is registered or subsequently registers his/her contact information with the national Do Not Call Registry.
      1. Following termination or deactivation of the Entrant’s Facebook account, or if the Entrant removes any content from the Entrant’s Facebook account, the Posted Contents may remain on the Channel perpetually subject to Facebook’s guidelines and rules.
      2. The Entrant acknowledges that the Bank does not own or host Facebook and the relevant privacy notices and other terms and conditions imposed by Facebook will apply.

      Miscellaneous

      1. The Bank reserves the right, in its sole and absolute discretion, to modify, suspend, withdraw and/or terminate the #GSSWithSC Contest (or part thereof) for any reason, including if a computer virus, bug, unauthorised human intervention or other cause (a “Disrupting Event“) corrupts or impairs the administration, security, fairness, judging, or proper play of the #GSSWithSC Contest. If the #GSSWithSC Contest is so modified, suspended withdrawn, or terminated, the Bank reserves the right to award Prizes to an Entrant from among all Entries received prior to the Disrupting Event.
      2. The Bank may at any time vary, modify, add or delete any of these terms without prior notice or reason. The Bank may in its absolute discretion at any time edit or remove any Posted Content that, which in its opinion breaches any of these terms or for any other reason.
      3. Except for death or personal injury caused by the negligence of the Bank, to the extent permitted by applicable law, you agree that the Bank and members of the Bank’s Group will not be liable, under any circumstances and in any way, for any errors or omissions, loss or damage of any kind incurred (including legal costs) as a result of your use of the Channel, participation (or inability to participate) in the #GSSWithSC Contest, any Posted Content or the acceptance of any Prize.
      4. To the extent that the Bank suffers any claim, loss, damage or judgment due to your acts or omissions (including, but not limited to, your participation in the #GSSWithSC Contest and the Posted Contents or breach of any of these terms by you), you agree to indemnify and hold the Bank, the Bank’s Group and their respective officers, employees and agents harmless.
      5. You acknowledge that the #GSSWithSC Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. To the extent permitted by applicable law, you agree that Facebook will not be liable, under any circumstances and in any way, for any errors or omissions, loss or damage of any kind incurred as a result of your use of the Channel and participation in the #GSSWithSC Contest.
      6. The Bank’s decision in all matters arising out of or in connection with the #GSSWithSC Contest is final and conclusive and no correspondence will be entertained.
      7. These terms and conditions are to be read in conjunction with and alongside our Customer Terms as well as any other of the Bank’s terms and conditions that may be applicable (collectively, “Other Terms”). If there are any inconsistencies between these terms and the Other Terms, these terms prevail only to the extent of such inconsistencies.
      8. A person who is not a party to these terms and conditions has no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of these terms and conditions.
      9. These terms and conditions are governed by and shall be construed in accordance with the laws of the Republic of Singapore and you agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
      10. All information is correct at the time of publication.
      11. For the purposes of these terms and conditions, “Group” means, in relation to the Bank:
        1. any person, body corporate, partnership, firm or other entity in which the Bank directly or indirectly:
          1. owns more than half the capital or business assets;
          2. has the power to exercise fifty percent (50%) or more of the voting rights;
          3. has the legal power to direct or cause the direction or general management or affairs;
          4. has the power to appoint more than half the members of the supervisory board, board of directors or other legally representative body; or
          5. has the right to manage the business;
          6. any person, body corporate, partnership, firm or other entity which directly or indirectly has in or over the Bank the rights or powers listed in (a) above (a “Controller“); and/or any person, body corporate, partnership, firm or other entity in which a Controller directly or indirectly has the rights or powers listed in (a) above.
